Conflicts between rights of women and the rest of the world
Women Empowerment has been a part of
countless political discussions in India. But, where does India actually stand
when it involves the Rights of Women? Especially once we compare ourselves to
the remainder of the world? To begin with... it’s only fair to say that on
paper, we look really, really good! India has passed a lot of specific laws for
women that protect them from: Sati, Dowry, Sexual Harassment, Child Marriage.
According to reports, there are over
2000 cases of female foeticide that happen every day! And that’s the reason our
sex ratio is skewed to 943 women to 1000 men. To put that in perspective, our
sex ratio is lower than countries like Uganda, Turkey, Mozambique and much more.
Even though we've of these laws – there are still over 34,000 cases of rape
that happen in India per annum. That’s 93 rapes a day! 4 rapes an hour! …. a
rape every 15 minutes. And these are just the cases that get reported...… And
we haven’t even touched on the number of sexual harassments, abuse, female
foeticide, and honor killings that occur every day! This makes us the 4th most
dangerous country for women in the world. We have gotten the right laws in
place-except marital rape...! It’s now on the govt to form the enforcement
agencies seem more approachable except for us, the primary step is to be
informed! Step two: Is to inform those
who wouldn’t have access to such information at all! Because you cannot defend
your rights, if you do not know them. And if you're still struggling, these are
institutions which will assist you get justice. So, what do you think? Are we
better than the rest of the world or do we have a long way to go?
Protection under the Constitution of India
We live in a shady and tousled world,
where lifetime of an individual is removed by a beloved, where goddesses are
worshipped while women are harassed. The only thanks to keep an eye fixed on
such horrific happenings is to form laws and rules. Most people are unaware of
their legal rights. Here are some legal rights that a woman gets in INDIA. When
a lady goes to a police headquarters without being amid a lawyer, she is either
quoted wrong, ignored or humiliated for her statements. She should be aware of
the fact that she has right to get legal aid. Under the LEGAL SERVICE
AUTHORITIES ACT, female rape victims have right to get legal aid or help from
authority to arrange a lawyer for her.
These are the following rights for women which comes under the constitution can leads to a better women's live.
RIGHT TO PRIVACY
A woman who has been harassed or raped has a right to record her statement in private in front of magistrate without being overheard. She also has freedom to record her statement with lady constable or policeman in personal whereas she could able to tell freely.
RIGHT TO UNTIMELY REGISTRATION
There are many reasons why woman
postpone going to the police to lodge a complaint. She considers her
reputation, dignity of family and threats from the culprit. Police in anyway cannot
say no to register her complaint, no matter if it’s too late to register. A
woman can’t be denied of anything.
RIGHT TO VIRTUAL COMPLAINTS
The law gives women the provision for filing virtual complaints via email or sending a written complaint to police station by post. After that, a police constable will be sent to their place to record the complaint by SHO. This is in case a woman is not in a position to physically visit police station.
RIGHT TO ZERO FIR
A FIR can be filed at any police
station irrespective of the location where the incident occurred under the ZERO
FIR that can later be moved to police station in whose jurisdiction the case
falls under. The ruling was passed by the Supreme Court to save victim’s time.
RIGHT TO NO ARREST
Unless there's an exceptional case on
the orders of a primary class magistrate, a lady can't be arrested after sunset
and before sunrise. In addition, the law states that police can interrogate a
woman at her residence only in presence of a woman constable and family or
friends.
RIGHT TOWARDS CRIME AND NOT A MEDICAL CONDITION
A case of rape can’t be dismissed
albeit the doctor says that the rape has not taken place. A victim of rape
needs to be medically examined and only the report can act as a proof. A woman
has a right to have a copy of the medical report from doctor.
RIGHT TO EQUAL PAY
According to provisions listed under the EQUAL REMUNERATION ACT, one cannot be discriminated on the basis of gender when it comes to salary, pay or wages. Working women have the right to draw equal salary, as compared to men.
RIGHT TO DIGNITY AND DECENCY
In an occasion that the accused may be
a woman, any check-up procedure on her must be performed by or within the
presence of another woman.
RIGHT AGAINST WORKPLACE HARASSMENT
The sexual harassment of women at workplace, act gives a female the right to file a complaint at her workplace. Under this act, she can submit a written complaint to an internal complaints committee at a branch office within a period of 3 months.
RIGHT AGAINST DOMESTIC VIOLENCE
Indian constitution looks to protect a
wife, female live in partner or a woman living in a household like mother or a
sister from domestic violence by the hands of a husband, male live in partner
or relatives. The accused shall be punished under non-bailable offense.
So, guys, not just women every citizen should be aware of their rules and regulations. What is the need to mentioned the above constitutional rights, why I mentioned?
Conclusion
The following rights are the rules made by the government of India which tells us the importance of women. It also tells that how women are facing serious problems. For the solution of the serious concerns, these rights are marked so that women can also feel free to live in this world. These rights are also for the society that tells them that women have equal rights to live. I know, many of them have been aware of the rights of women but still, my main agenda is people read this and try to understand. So that, society can awake and give an equal way of treating everyone. This article was for the raising hand against the women atrocities like clearly, I have mentioned in this article. So, at last, these are the only way of giving a better life to women.
